1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any waste collection, removal, clearance, loading, transportation, sorting or related activity we carry out for you.
1.2 We, us and our refer to the company providing the waste collection service.
1.3 You and your refer to the customer ordering the Service, whether as an individual, business, landlord, tenant, managing agent or other organisation.
1.4 Premises means the property, building, land or access route where the Service is to be carried out.
1.5 Waste means any items, materials, refuse, rubbish, junk or debris to be removed as part of the Service, excluding any prohibited or hazardous materials specified in these Terms.
2. Scope of Service
2.1 We provide waste collection and related services for domestic, commercial and industrial customers within Catford and nearby localities, subject to capacity and operational constraints.
2.2 The Service may include one-off clearances, recurring waste collections, bulky waste removal, garden waste collection, or other waste-related tasks as agreed in writing or confirmed at the time of booking.
2.3 We reserve the right to refuse to collect certain items that are unsafe, prohibited by law, or not reasonably accessible, including but not limited to hazardous substances, clinical waste, asbestos, gas bottles, explosives, chemicals or substances requiring specialist treatment.
2.4 Any description of the Service in our advertising or marketing material is for general guidance only. The exact Service we provide will be as agreed with you at the time of booking or as otherwise confirmed in writing.
3. Booking Process
3.1 You may request a Service by telephone, email, online enquiry or other approved booking method. Bookings are subject to availability and acceptance by us.
3.2 When making a booking, you must provide accurate and complete information, including the type and approximate volume of waste, the location of the Premises, access details, any parking restrictions, and any health and safety issues that may affect the Service.
3.3 We may provide an initial estimate based on the information you supply. This estimate is not a fixed price and may be revised on site once our operatives have inspected the Waste and Premises.
3.4 Your booking is confirmed only when we have accepted it and provided you with a booking confirmation, which may be verbal, by email, text message or other written format.
3.5 You confirm that you are either the owner of the Premises or have the authority of the owner or occupier to authorise us to collect Waste from the Premises and to enter and operate there as reasonably required to carry out the Service.
4. Access and Parking
4.1 You must ensure that we have safe, reasonable and lawful access to the Premises at the agreed time and date, including necessary parking or loading space for our vehicles.
4.2 Any parking permits, visitor passes or authorisations required for our vehicles are your responsibility unless we have expressly agreed otherwise in writing.
4.3 If we incur parking charges, penalty charge notices or similar costs as a direct result of carrying out the Service at your request, you agree that these may be added to the final invoice and are payable by you.
4.4 If we are unable to gain access to the Premises, or if access is unsafe or significantly restricted, we may cancel or postpone the Service, and a call-out or cancellation fee may apply as set out in these Terms.
5. Pricing and Quotations
5.1 Prices for the Service may be based on a range of factors including type and volume of Waste, labour time, access conditions, distance, and disposal or recycling fees.
5.2 Any quotation or price guide we provide prior to attendance is an estimate only, based on the information given by you. The final price will be confirmed once our operatives have inspected the Waste and Premises.
5.3 Where the actual amount or type of Waste differs from that described at the time of booking, or where access is more difficult than disclosed, we may adjust the price accordingly. You will be informed of any change before we commence work.
5.4 If you choose not to proceed after we have attended and provided a revised price on site, we reserve the right to charge a reasonable call-out or attendance fee to cover our costs.
6. Payments
6.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due on completion of the Service and before our operatives leave the Premises.
6.2 We may accept payment by cash, bank transfer, card or other methods as notified to you. We reserve the right to refuse certain payment methods at our discretion.
6.3 For commercial customers and account holders, we may agree alternative payment terms such as payment within a specified number of days from invoice. Such terms must be agreed in writing.
6.4 All prices are stated exclusive of VAT unless clearly indicated otherwise. If VAT is applicable, it will be added at the prevailing rate.
6.5 If you fail to make payment when due, we may charge interest on the overdue amount at the statutory rate and recover any reasonable costs we incur in pursuing the debt, including legal and recovery costs.
7. Cancellations and Amendments
7.1 You may cancel or reschedule a booking by contacting us as soon as reasonably possible.
7.2 If you cancel more than 24 hours before the scheduled start time, no cancellation fee will usually apply, unless we have incurred specific costs or ordered special equipment for your job.
7.3 If you cancel within 24 hours of the scheduled start time, or if we are unable to carry out the Service due to your act or omission, we reserve the right to charge a reasonable cancellation or call-out fee to cover our costs.
7.4 We may cancel or reschedule the Service due to circumstances beyond our reasonable control, including severe weather, traffic incidents, vehicle breakdown, staff illness, safety concerns or regulatory requirements. In such cases, we will seek to agree a new date and time with you, and no cancellation fee will apply.
8. Customer Responsibilities
8.1 You are responsible for ensuring that the Waste we are asked to remove is your property or that you have full authority to dispose of it. You indemnify us against any claim arising from the removal of items you did not have authority to discard.
8.2 You must separate any items that you do not wish us to remove and clearly indicate them to our operatives.
8.3 You must inform us in advance if any Waste may contain hazardous or regulated materials, or if there are any known risks to health and safety at the Premises.
8.4 You agree not to place in the Waste any items that are prohibited, hazardous, illegal or unsuitable for normal collection and disposal. If such items are discovered, we may refuse to collect them, charge additional fees for specialist handling, and notify the relevant authorities if required by law.
9. Our Responsibilities and Service Standards
9.1 We will provide the Service with reasonable care and skill, in line with applicable UK legislation and industry standards for waste management.
9.2 We will take reasonable steps to minimise disruption to you and to leave the area where we have worked in a tidy condition, subject to the nature of the clearance and the condition of the Premises.
9.3 We will transport and dispose of Waste collected from your Premises at authorised facilities, in accordance with the relevant waste regulations, duty of care obligations and environmental standards.
9.4 We may photograph the Waste and work area before and after the Service for record-keeping, proof of work, compliance and training purposes.
10. Waste Regulations and Compliance
10.1 We operate in accordance with UK waste management legislation and any local regulatory requirements that apply to waste collection and disposal.
10.2 We will only use licensed transfer stations, recycling centres and disposal facilities for the Waste collected under the Service, and we will maintain appropriate records of waste movements as required by law.
10.3 Where necessary, and particularly for commercial customers, we may issue waste transfer notes or other documentation to evidence the lawful transfer and handling of Waste. You must retain any such documentation for your records and legal compliance.
10.4 You agree that no Waste we collect will include controlled, hazardous or specialist materials unless we have explicitly agreed in writing to handle such Waste and you have provided full and accurate disclosure of its nature.
11. Liability and Limitations
11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.
11.2 Subject to the above, we will not be liable for any loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of reputation, or any indirect or consequential loss arising out of or in connection with the Service.
11.3 Our total liability to you in respect of any claim arising out of or in connection with the Service, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by you for the Service giving rise to the claim.
11.4 You must notify us in writing of any damage or issue that you attribute to our Service as soon as reasonably possible and in any event within 7 days of the Service being carried out. We may require evidence and the opportunity to inspect the alleged damage before any remedial steps are taken.
11.5 We are not liable for any pre-existing damage or defect at the Premises, or for any damage that is unavoidable due to the nature of the work and which has been brought to your attention beforehand where reasonably possible.
12. Insurance
12.1 We maintain public liability insurance and other appropriate policies in relation to the provision of waste collection services.
12.2 Details of our insurance cover are available on request. Our liability to you, however, remains limited as set out in these Terms and Conditions.
13. Data Protection and Privacy
13.1 We will process any personal information you provide to us in connection with the Service in accordance with applicable data protection laws.
13.2 We may use your data for purposes including managing your booking, providing the Service, processing payments, record-keeping, and, where permitted, contacting you about related services.
13.3 We will not sell your personal data to third parties. We may share your information with service providers and authorities where necessary for operational, legal or regulatory reasons.
14. Complaints
14.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible so that we can investigate and seek to resolve the issue.
14.2 We may ask you for supporting information, including photographs or written details, to help us assess your complaint.
14.3 We will respond to complaints in a fair and timely manner and, where appropriate, may offer to re-attend, rectify the problem, or provide another form of resolution at our discretion.
15. Variations to Terms
15.1 We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to you.
15.2 The Terms and Conditions that apply to your booking are those in force at the time you make the booking, unless a change is required by law or regulatory authority, in which case the updated terms may apply to existing bookings.
16. Severability
16.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
17.1 These Terms and Conditions, together with any written confirmation or agreement relating specifically to your booking, constitute the entire agreement between you and us in relation to the Service.
17.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales.
18.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
